Mevsılî'nin el-İhtiyâr Li Ta'lîli'l-Muhtâr isimli eserinde ibadetler özelinde mezhep içi görüş ayrılıkları

Abstract

Bu çalışma, Mevsılî’nin el-İhtiyar li-Ta’lîl’il Muhtâr isimli eserinde ibadetler özelinde mezhep içi görüş ayrılıklarını araştırmayı amaçlamaktadır. Hanefî mezhebi kurucusu Ebû Hanîfe ve onun öğrencileri Ebû Yusuf, İmam Muhammed ve İmam Züfer arasında; tahâret, namaz, zekât, oruç ve hac konularında ortaya çıkan ihtilâflı meseleler tespit edilmeye çalışılırken dayandıkları gerekçeler delillendirilerek ortaya konmuştur. Çalışmanın asıl amacı, ihtilâfların tespiti ve delillendirilmesi sonucu ortaya çıkan mezhep içi ictihad çeşitliliğini gözler önüne sermektir. Araştırmada nitel yöntem uygulanmıştır. Bu yöntem uygulanırken eser; çeviri yoluyla incelenmiş, Hanefî mezhebi literatürü taranmış, klasik kaynaklardan okumalar yapılmıştır. İhtilâflar tek tek tespit edilmiş ve sistemli bir biçimde sınıflandırılmıştır. Tezimizde ihtilâflı olan meseleleri 5 ana başlık ve 61 alt başlık olacak şekilde tahkik ettik. İhtilâf sebeplerinin; nasların yorumu, hadislerin dereceleri ve aynı fıkhî meseleye farklı ictihad yöntemlerinin uygulanmasından veya aynı yöntem uygulanmış olsa bile uygulama farklılığından kaynaklı olduğunu tespit ettik.

This study aims to examine intra-school differences of opinion concerning acts of worship in Mevsılî’s work al-Ikhtiyār li-Ta‘līl al-Mukhtār. It seeks to identify disputed issues that emerged between the founder of the Hanafī school, Abū Ḥanīfa, and his students Abū Yūsuf, Imām Muḥammad, and Imām Zufar in matters of purification, prayer, almsgiving, fasting, and pilgrimage, and to present these disputes by substantiating the evidences and justifications upon which they are based. The primary objective of the study is to reveal the diversity of intra-school juristic reasoning (ijtihād) that arises as a result of identifying and evidencing these differences of opinion. A qualitative research method has been employed in this study. Within this framework, the work was examined through translation, the Hanafī legal literature was surveyed, and readings from classical sources were conducted. The disputed issues were identified individually and classified in a systematic manner. In this thesis, the disputed matters were examined under 5 main headings comprising a total of 61 subheadings. It was determined that the causes of these differences stem from the interpretation of scriptural texts, the classification and evaluation of ḥadīths, and the application of different methods of juristic reasoning to the same legal issue, or from differences in application even when the same method was employed.
