İslam Felsefesinde Hak ve Hürriyet Kavramları

Abstract

Makale, insan hakları ve hürriyet kavramlarını İslam felsefesi bağlamında ele almaktadır. İnsan haklarının tarih boyunca biyolojik ihtiyaçların ötesinde bir kavram olduğu ve İslam filozoflarının temel amacının evrensel insan hakları olduğu vurgulanmıştır. Hürriyet, İslam'da yaşam, mülkiyet ve düşünce gibi temel haklar arasında yer alırken, insanın sosyal bir varlık olması nedeniyle hak ve hürriyetlere duyduğu ihtiyaç açıklanmıştır. Kur'an'da insan "eşref-i mahlukat" olarak tanımlanmış, hak kavramının ise bâtılın zıddı anlamında sıkça kullanıldığı belirtilmiştir. Makale, İslam filozoflarının hak ve hürriyetle ilgili görüşlerine odaklanmaktadır. Ragıb el-İsfahani, Kindî ve Gazali gibi filozofların bu konudaki yaklaşımlarına da yer verilmiştir. Adalet hem bireysel hem toplumsal bir gereklilik olarak değerlendirilmiş ve İslam felsefesinde varlık düzeyinde ele alınmıştır. Ayrıca hak kavramının klasik eserlerdeki kullanımına örnekler verilmiştir. İnsan hakları kavramının evrensel bir çerçevede ele alınmasına rağmen, farklı inanç ve kültürel yapılarla çelişkiler doğurabileceği belirtilmiştir. İslam'da hakların korunmasına yönelik Kur'an ve sünnette yer alan örnekler aktarılmış; teorik düzeyde güçlü bir sistem olmasına karşın, uygulamalarda eksiklikler yaşandığı ifade edilmiştir. Son olarak, İslam filozoflarının hürriyet kavramına yaklaşımları incelenmiş; Farabi, İbn Sina ve İbn Miskeveyh gibi düşünürlerin katkıları ele alınmıştır. Hürriyetin bireysel ve toplumsal gelişimdeki rolüne değinilmiş ve İslam’ın hak ve özgürlük anlayışında üst düzey bir önem atfettiği vurgulanmıştır. The article discusses the concepts of human rights and freedom in the context of Islamic philosophy. It has been emphasized throughout history that human rights are a concept beyond biological needs and that the main aim of Islamic philosophers is universal human rights. While freedom is among the fundamental rights such as life, property and thought in Islam, the need for rights and freedoms that humans need because they are social beings has been explained. In the Quran, human beings are defined as "the noblest creatures" and it is stated that the concept of right is frequently used in the sense of the opposite of falsehood. The article focuses on the views of Islamic philosophers on rights and freedom. The approaches of philosophers such as Ragıb el-İsfahani, Kindi and Gazali on this subject are also included. Justice has been evaluated as both an individual and a social necessity and has been discussed at the level of existence in Islamic philosophy. Additionally, examples of the use of the concept of right in classical works are given. It has been stated that although the concept of human rights is considered in a universal framework, it may cause contradictions with different beliefs and cultural structures. Examples in the Quran and Sunnah regarding the protection of rights in Islam are cited; Although it is a strong system at the theoretical level, it has been stated that there are deficiencies in practice. Finally, the approaches of Islamic philosophers to the concept of freedom were examined; The contributions of thinkers such as Farabi, Ibn Sina and Ibn Miskawayh are discussed. The role of freedom in individual and social development was mentioned and it was emphasized that Islam attaches high level of importance to the understanding of rights and freedom.
