Eğitim kurumlarında iş sağlığı ve güvenliği incelenmesi: Bilecik/Bozüyük örneği

Abstract

İş Sağlığı ve Güvenliği Kanunun amacı, çalışma ortamlarını sağlıklı ve güvenli hale getirmekle birlikte işveren ve çalışanların haklarını korumaktır. Sağlığın ve güvenliğin sağlanmasında en temel etken güvenlik kültürüne sahip olan bireyler yetiştirmektir. Bir toplumda güvenlik kültürü oluşturabilmek için eğitimlerin küçük yaşlardan itibaren verilerek farkındalığın artırılması sağlanmalıdır. 6331 İş Sağlığı ve Güvenliği Kanunu, kamudaki ve özel sektördeki iş yerlerinin yanı sıra eğitim kurumlarıyla da ilgili hükümler içermektedir. Milli Eğitim Bakanlığı (MEB) İş Sağlığı ve Güvenliği 2014/16 sayılı genelge doğrultusunda okullarda sağlık ve güvenlik tedbirleri ile ilgili bir dizi çalışmalar yürütülmektedir. İşyeri Sağlık ve Güvenlik Birimi (ISGB) her ilde bir merkez bulunması zorunludur. Güvenli bir ortamın oluşturulmasında başta okul müdürü olmak üzere öğretmenler ve diğer personeller de mevzuatta yer alan hükümlerden sorumludurlar. Milli Eğitim Bakanlığı tarafından görevlendirilen uzman kişiler tüm okul çalışanlarına iş sağlığı ve güvenliği ile ilgili eğitim konferans ve paneller düzenlemektedir. Bunun sonucunda da yönetmelikte yer alan maddelere uygun bir şekilde okulun ve çevrenin fiziki yapısının düzenlenmesi istenmektedir. Okul müdürleri sorumluluklarının bir parçası risk analizleri ve acil durum planları hazırlamalı ve okulda meydana gelebilecek riskleri önceden tespit etmelidir. Personel ve öğrencilere gerekli tatbikatlar yaptırılmalı, doğal afet, yangın veya olası riskler öncesinde, sırasında ve sonrasında neler yapılması gerektiği ile ilgili farkındalık oluşturulmalıdır. MEB tarafından yetkilendirilen uzman kişi tarafından okulların iş sağlığı ve güvenliği gözetim alanları sıklıkla denetlenmeli ve eksiklikler giderilmelidir. Bu konuda tüm çalışanlar ve öğrenciler üzerlerine düşen sorumlulukları yerine getirmelidir. Bu çalışmada işveren statüsünde değerlendirilen okul müdürünün iş sağlığı ve güvenliği alanındaki sorumlulukları, iş güvenliği uzmanlarının görevleri incelenmiştir. Bilecik/ Bozüyük’te bulunan bir kısım okulda (ilkokul-ortaokul) iş sağlığı güvenliği uygulama alanları incelenmiştir. Mevzuattaki talimatların birçoğunun yerine getirildiği görülmüştür. Tespit edilen eksiklikler belirlenmiştir. Araştırmanın sonucu okul müdürlerine bildirilmiştir.

The purpose of the Occupational Health and Safety Law is to protect the rights of employers and employees as well as to make working environments healthy and safe. The most basic factor in ensuring health and safety is to raise individuals who have a safety culture. In order to create a culture of safety in a society, it should be ensured that awareness is raised by giving trainings from an early age. The Occupational Health and Safety Law No. 6331 contains provisions regarding educational institutions as well as workplaces in the public and private sectors. In line with the Ministry of National Education Occupational Health and Safety Circular No. 2014/16, a series of studies are carried out on health and safety measures in schools. In creating a safe environment, teachers and other personnel, especially the school principal, are also responsible for the provisions in the legislation. Experts assigned by the Ministry of National Education provide training on occupational health and safety to all school employees. In this study, the responsibilities of the school principal, who is considered as an employer, the authority and responsibilities of occupational safety experts, and the occupational health and safety practices implemented in educational institutions (primary and secondary schools) will be examined.School principals should fulfill their responsibilities and determine the risks that may occur in the school in advance and prepare risk analyzes and emergency plans. Staff and students should be made to do the necessary drills, and awareness should be raised about what to do before, during and after natural disasters, fires or possible risks. Occupational health and safety surveillance areas of schools should be frequently inspected by an expert authorized by the Ministry of National Education and deficiencies should be eliminated. In this regard, all employees and students must fulfill their responsibilities.In this study, the responsibilities of the school principal in the field of occupational health and safety, which are evaluated as employers, and the duties of occupational safety experts were examined. Occupational health and safety application areas in some schools (primary-secondary school) in Bilecik / Bozüyük were examined. It has been observed that many of the instructions in the legislation have been fulfilled. The identified deficiencies have been identified. The result of the research was reported to the school principals.
