Kamu Alacaklarının Tahsilinde Nakit Dışı Tahsil Yöntemleri

Abstract

Bu çalışmada kamu alacaklarının takip ve tahsiline yönelik pozitif hukuk kurallarının, para ile tatmin ilkesi başta olmak üzere, kamu alacaklarının tahsilinde egemen olan ilkelere uygunluğunun test edilmesi amaçlanmıştır. Çalışmamızda konuyla ilgili literatür ve mevzuat taramasına dayalı bir araştırma yöntemi uygulanmıştır. Yapılan araştırma sonucunda ulaşılan bulguların değerlendirilmesi, güncelliğinin tartışılması, ekonomik ve toplumsal yapıya uygunluğu da dikkate alınarak sistematik yapısı analiz edilmeye çalışılmıştır. Ayrıca, kamu alacaklarının tahsiline yönelik düzenleme ve uygulamaların aksayan yönlerine de işaret edilerek konu hakkındaki önerilerimize yer verilmiştir.

In this study, follow-up and collection of public receivables for provision of positive law, particularly the principle of satisfaction with money, it is aimed to test the compliance with the principles prevailing in the collection of public receivables. The research method based on scanning the relevant literature and legislation is applied in our study. The evaluation of the research findings, discussion of contemporaries and suitability taking into account the economic and social structure has been studied to analyze the systematic structure. In addition, our recommendations have been included on the subject by pointing out the shortcomings in the arrangements and practices for the collection of public receivables
