Osmanlı Türk Anayasalarında hükümet sistemleri: 2007 sonrası sistem tartışmaları

Abstract

Osmanlı Türk Anayasalarında hükûmet sistemleri ve 2007 sonrası sistem tartışmaları adını alan Yüksek Lisans Tezi, Osmanlı-Türk siyasî hayatında uygulanan hükûmet sistemlerinin, tarihî gelişim ve seyri içerisinde geçirdiği değişim ve dönüşümü, bu kapsamda yaşanan tartışmaları, bir süreç analizini de içerisine alacak şekilde incelemiştir. Hükûmet sistemlerinin Türk Anayasalarında ele alınış biçimi, yapılan anayasa değişiklikleri, sisteme yapılan eleştirileri ve konunun muhatapları tarafından değerlendirilmesi siyasî, hukukî ve sosyal gelişmeler göz önünde tutularak ele alınmıştır. Hükûmet sistemi tartışma ve arayışlarının netice olarak ABD tipi Başkanlık hükûmet sistemi bağlamından Türk Tipi bir Cumhurbaşkanlığı hükûmet sistemi perspektifine dönüşmesini, yapılan anayasa değişikliklerini ve getirilen anayasal kurumların yeni sistemde konumlanmasını, işleyişini ve dezavantajlarını hukukî ve siyasî boyutlarıyla inceleyen çalışmanın, önümüzdeki birkaç dönem daha sürecek gibi görünen hükûmet sistemi tartışmaları ve çalışmalarına bu anlamda katkı sağlayacağını umut etmekteyim.

The Master Thesis, which is named as the governmental systems in the Ottoman Turkish Constitutions and the post-2007 system discussions, examined the changes and transformations of the governmental systems applied in the Ottoman-Turkish political life in the historical development and course, and the debates in this context, including a process analysis. The way the government systems are handled in the Turkish constitutions, the constitutional amendments made, the criticisms made to the system and the evaluation of the issue by their interlocutors have been dealt with in consideration of political, legal and social developments. The study, which looks at the legal and political dimensions of the government system, from the context of the US type Presidential government system to the perspective of the Turkish type Presidential government system, the constitutional amendments made and the position, functioning and disadvantages of the constitutional institutions in the new system will continue for the next few periods. I hope that this will contribute to the discussions and studies of the government.
