XIX. ve XX. Yüzyıllarda Canik Sancağı hapishaneleri

Abstract

Suç ve ceza; insanlık tarihi kadar eski bu iki kavramın anlamına bakıldığında tarih çizgisi boyunca birden fazla şekil değiştirdiğini görebiliriz. Bu konuda modernleşme süresine geçilene kadar cezalar genellikle bireyin bedenine yönelik bir uygulama olarak karşımıza çıkarken modernleşme ile beraber insana verilen değer farklılık göstermiş ve bedenin kutsallığına dokunulmamaya özen gösterilmiştir. Suç işleyenlerin elbet cezasını çekeceği bir süreç olmalıdır ancak bu bedene yönelik değil özgürlüğü kısıtlamaya yönelik olacaktır. Modernleşme döneminde suçlar karşısında verilen ceza hapsetmeye yönelik olarak karşımıza çıkmaktadır. Avrupa’da hapishanelerin modern döneme ayak uydurması anlamında yapılan reform hareketleri kısa süre içinde Osmanlı devletini de etkilemiştir. İncelediğimiz Canik Sancağı Hapishaneleri yapılan reformlar ışığında nasıl değerlendirildiği ele alınmaya çalışılmıştır. Bulunana ilk hapishane kayıtlarından anlaşılacağı üzere harap ve viran bir halde olan hapishanelerde sağlık koşulları gözetilerek çalışmalar yapılmaya gayret edilmiştir. Gerek hapishane gerek hapishane görevlileri ve mahkûmların incelendiği tezimizde birçok hususun yeterli olmadığı saptanmış, ihtiyaç olunan durumlar tespit edilerek ilgili nezaretlere bildirilmiş olsa dahi kötü gidişat bir türlü istenilen düzeye ulaşamamıştır

Of course, there should be a process in which the perpetrators will be punished, but this will be aimed at restricting freedom, not again sit the body. In the modernization period, the punishment given for crimes appears to be in cancelation. Reform movements in Europe in terms of keeping up with the modern period of prisons also affected the Ottoman state in a short time. It has been tried to deal with how the Canik Sanjak Prisons, which we examined, were evaluated in the light of these forms. As it can be under stood from the first prison records found, efforts were made to carry out studies in prisons, which were in a dilapidated state, by considering the health conditions. In our thesis, in which both the prison, prison Officers and prisoners were examined, it was determined that many issues were not sufficient,and even though the necessary situations were determined and reported to their levant ministries, the bad situation could not reach the desired level.
